These Terms of Service govern your access to and use of the Scaled platform and website. By creating an account or using the service, you agree to these terms. If you do not agree, do not use the service.

The service

Scaled provides a software platform for catering operations, including orders, prep planning, purchasing, scheduling, equipment, and related tools. We may update, add, or remove features over time.

Accounts and registration

You must provide accurate information when creating an account and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Subscriptions, billing, and trials

Scaled is offered on a subscription basis, with pricing based on your number of members and locations. New accounts may start with a free trial. Fees are billed in advance on a monthly or annual basis and are non-refundable except where required by law.

You can add or remove members and locations, and changes are prorated or applied at the next billing cycle as described at the time of the change. If a payment fails or a trial ends without a subscription, access may be limited until the account is brought current.

Acceptable use

You agree not to misuse the service, including by attempting to gain unauthorized access, disrupting the service, uploading unlawful content, or using it to violate the rights of others.

Customer data and content

You retain ownership of the data you put into Scaled. You grant us the rights needed to host and process that data in order to provide the service. You are responsible for the accuracy and lawfulness of the data you submit.

Intellectual property

Scaled and its underlying software, design, and content are owned by us and protected by intellectual property laws. These terms do not grant you any ownership of the platform itself.

Third-party services

The platform may integrate with third-party services, such as payment processing and payroll export. Your use of those services is subject to their own terms, and we are not responsible for them.

Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid for the service in the twelve months before the claim.

Termination

You may stop using the service and cancel your subscription at any time. We may suspend or terminate access if you breach these terms. On termination, your data is handled as described in our Privacy Policy and the platform's data retention practices.

Changes to these terms

We may update these terms from time to time. When we make material changes, we will update the date at the top of this page and, where appropriate, notify you. Continued use of the service after changes take effect means you accept the updated terms.

Governing law

These terms are governed by the laws of the jurisdiction in which Scaled operates, without regard to its conflict-of-law principles.
